TERMS & CONDITIONS
1. Any & all announcements made from the Auction Block take precedence over all printed material & advertising. The information provided in this catalog is deemed correct, but is in no way guaranteed. We will in no way be held responsible if the information provided to us was incorrect to begin with. While descriptions are believed to be correct, the Auctioneers or owners make no warranties or guarantees as to the genuineness, authenticity of or defect of any items & will not be held responsible for advertising discrepancies or inaccuracies. It is our sincerest intention to provide the potential buyer all the information that pertains to the subject property.
2. Property will be auctioned subject to Undisclosed Seller's Reserve. No offers to purchase will be accepted without final written consent of seller. The seller reserves the right to accept, reject or counter the high bid within 48 hours after the auction close based on any and all conditions proposed by the high bidder.
3. there will be a $2,000 non-refundable deposit due on auction day. At the close of the auction, the high bidder will sign a contract for the offer to purchase the property which will be submitted to the sellers for consideration along with the deposit monies equaling $500 per lot. Assuming final negotiations result in the sale of the property, the deposit monies will be placed on deposit with the escrow agent of your choice. As soon as both parties agree in writing to the sale the deposit monies are then considered non-refundable for any reason.
4. Closing: The high bidder is responsible for producing a letter of intent within 5 days of closing from a financial institution.
5. The property is being sold “as-is and where-is” with all faults if any. No warranty as to condition or suitability for any purpose is expressed or implied. Buyers shall rely entirely on their own information, judgment and inspection of the property and records prior to the auction. No Guarantee is made about the suitability of the property for any specific purpose.
6. The high bidder is responsible for obtaining his own financing. All bidders should have financing secured in advance of the auction to be certain of their ability to close. Deposit monies are non-refundable.
7. Title. The contract to purchase this property is subject to the seller being able to provide an insurable title.
8. Buyer will pay all closing costs associated with this transaction.
9. All adjustments of taxes, etc. shall be prorated as of the date of closing.
10. Back-up bidder(s): If you wish to submit a back up offer after the auction closes, please see the auctioneer after the auction. You will be placed on a list as next in line in the event the high bidder does not close. You would then be contacted and invited to submit an offer to purchase at which point you may accept or decline. There is no obligation to purchase. This is a matter of reference only.
